The delivery times specified below are provided for information only. Current circumstances are disrupting our operations and deliveries may be subject to delays. 

Please read these General Terms and Conditions of Sale and General Terms and Conditions of Use of the Selyes.fr website carefully.

1. Seller identification

These general terms and conditions of sale apply to the sales defined below and carried out by the company Selyès Entreprise Individuelle, whose head office is located at 304 rue du moulin - 45520 Gidy - FRANCE, registered in the Orléans Trade and Companies Register under number 912 336 450. Its Siret number is 912 336 450 00016 and its intra-community VAT number is FR 35 912336450. The company is not subject to VAT. Its telephone number is +33 (0)6 13 83 82 08.

2. Scope and acceptance of the General Terms and Conditions of Sale

The purchase of products offered on the website https://selyes.fr (hereinafter the "Site") and/or by telephone and/or via the brand's social networks is subject to these general terms and conditions of sale ("General Terms and Conditions of Sale").

The Site allows you to order a selection of Selyès brand products (hereinafter the "Product(s)") from Selyès EI online via the internet.

The Selyès Products are exclusively intended for sale to end consumers who are natural persons or legal entities, to the exclusion of all resellers or intermediaries acting on behalf of resellers. Therefore, the customer declares that he/she is acting as an end consumer and does not intend to resell, directly or indirectly, the Selyès Products for commercial purposes.

The customer certifies that he/she has the legal capacity to enter into the commitments set forth herein.

Selyès may update these General Terms and Conditions of Sale at any time. You can view the current version of the General Terms and Conditions of Sale at any time by visiting the "General Terms and Conditions of Sale" section of the Site.  The contract of sale between you and Selyès will include the terms and conditions of your order and the general terms and conditions of sale applicable at the time of your purchase, which shall apply to the exclusion of any other terms and conditions or any implied terms and conditions of Selyès. 

In addition, each time you make a purchase on the Site, you will be asked to confirm your acceptance of these General Terms and Conditions of Sale in force on the date your order is placed. These terms and conditions can be viewed before and at the same time as you are asked to confirm your acceptance of them. To confirm your acceptance, you must tick the box "I accept the General Terms and Conditions of Sale, and consent to the processing of my data in accordance with the Selyès Privacy Policy". You can consult the Selyès Privacy Policy at any time by clicking on the link entitled "Personal Data".

3. How to order

For any questions relating to the Products and your orders, you can contact our customer service department (hereinafter "Customer Service") by clicking on the "Contact Us" link or by telephone on +33 (0)6 13 83 82 08, Monday to Friday (excluding public holidays), from 9am to 6pm.

The Site allows you to order a selection of Products online via the Internet from Selyès for collection or delivery under the conditions specified in article 8.1 "Delivery and collection area".

You may also order by telephone by contacting our Customer Service Department.

The Site does not allow the direct placing of special orders known as "Custom Orders" which consist in particular in the creation of a product not existing in the Selyès collection, or in the adaptation/modification of a product from the Selyès collections. For all special orders, please contact us by clicking on the "Contact us" link or by telephone on +33 (0)6 13 83 82 08, Monday to Friday (excluding public holidays), from 9am to 6pm. 

However, the present General Terms and Conditions of Sale will apply to any purchase of personalized products at your request (see article 4.2 below).

4. Product availability

4.1 Provisions specific to pre-orders

Pre-ordering refers to the possibility for the customer to reserve certain Products indicated on the Site before their release date (hereinafter the "Pre-order" or the "Pre-ordered Product").

4.2 Provisions specific to Personalization

Personalization refers to the possibility for the customer to adapt or personalize certain Products from the Selyès collections (hereinafter the "Personalization" or the "Personalized Product").

4.3 Product availability

Products are made to order, therefore there is no permanent stock.

Furthermore, Selyès reserves ownership of the Products until payment for the Products has been received in accordance with the provisions of article 7 below. 

The date of availability of a pre-ordered Product will be expressly indicated on the product sheet. 

In the event that a Product is unavailable after you have placed your order, we will inform you by e-mail or telephone as soon as possible, offering you either to order another Product presented on the Site as a replacement, or to cancel your order.

Selyès accepts no liability in the event that Products are out of stock or unavailable.

Selyès reserves the right to change the Products offered on the Site and/or by telephone at any time and without prior notice.

In order to ensure a better quality of service and availability of our Products to all our customers, Selyès reserves the right to limit the quantity of Products that may be purchased by a customer, in accordance with the applicable provisions in this regard and in particular those of Article L. 121-11 of the French Consumer Code.

4.4 Product lead times

All products made to measure and/or with personalization (choice of colors, buckles, engraving, etc.) require a production time ranging from four (4) to eight (8) weeks.

These times are to be taken into account in addition to delivery times - see article 8.3 "Delivery and in-store collection".

5. Ordering procedure

5.1. Order procedure on the Site

5.1.a) Product selection

You can add Products to your selection at any time by clicking on "Add to basket".

You can view your selection by clicking on "Basket" in the top right-hand menu, where you will see: the photo(s) of the Product(s), its (their) color(s) and reference(s), the quantity(ies) chosen, its (their) unit price(s) and the subtotal of the selection.

5.1.b) Identification

After selecting the Product(s), click on "Order" to start the ordering process.

A customer account is required to place an order on the Site:

- If you already have a customer account, you will need to identify yourself at this stage by entering your password.

- If you do not yet have an account, you will be invited to create one by confirming your e-mail address and creating a password later.

Your login and password are strictly personal, and you therefore undertake to keep them safe and never to pass them on to third parties. In the event of loss, theft or any fraudulent use of your customer account, you undertake to inform Selyès immediately.

Creating an account allows you to :

- track your deliveries and consult your order history;

- return or exchange products;

- add or modify your delivery and billing addresses for future orders;

- manage your Selyès newsletter subscriptions.

Unless proven otherwise by the customer, the data recorded by the Site constitutes proof of the nature, content and date of all transactions between Selyès and its customers. In the event of a dispute between Selyès and one of its customers concerning a transaction carried out on the Site, the data recorded by Selyès shall be considered valid proof of the content of the transaction, unless the customer provides proof to the contrary.You may deactivate your account at any time by sending an e-mail to Customer Service by clicking on the "Contact Us" link.

5.2. Validation of orders placed on the Site

5.2.a) Validation of delivery method

You will need to validate your delivery method and fill in the delivery information required for your order to be dispatched: country of dispatch, title, first name, surname, telephone number, delivery address (or the collection point from which you wish to collect your order - see Article "8.1 Delivery and collection zone") and any other information required to process your order. Once you have completed this step, click on "Continue".

5.2.b) Order payment confirmation

You may use your delivery address as your billing address, or enter a different one. You will then be asked to select a payment method (see Article "6. Prices - Accepted payment methods") and to enter the relevant information. At the end of the ordering process described above and after having accepted the present Terms and Conditions of Sale and Use and the Privacy Policy of the Site, click on the "Pay" button.To confirm a pre-ordered Product, a customized Product or any other Product requiring an extended shipping time, you must also authorize Selyès to save your bank details, until the shipment of the said Product and for a maximum period of 2 months, for the purpose of debiting your account upon shipment of your order.

Please check the accuracy of your selection before confirming your order. While every effort is made to ensure that the color and design of the Products whose photos are displayed on the Site are faithful to the original Products, variations may occur, notably due to the technical limitations of color rendering on your computer equipment. 

Selyès cannot be held responsible for non-substantial errors or inaccuracies in the photographs or graphic representations of the Products shown on the Site.

You must check the accuracy of the measurements/sizes entered when placing your order. Selyès manufactures its products in strict accordance with these measurements and cannot be held responsible in the event of a measurement error by the customer, following the size guide provided on the site. We recommend that you use a tape measure and adjust it to the desired size.

If you have any questions about the Products, please contact our Customer Service Department.

For more information on payment methods (currencies, accepted payment methods, etc.), please refer to the section below entitled "6. Once completed, your order is transmitted to Selyès for processing. The sales contract will be formed once we have received your order. We will proceed with the shipment of your Product as soon as it has been completed in our workshops for you (as described above) and payment for the Product has been received.

Selyès reserves the right not to accept an order from a customer with whom it is in dispute over a previous order, or if Selyès reasonably believes that such customer has violated these Terms and Conditions or engaged in fraudulent activity, or for any other legitimate reason.

5.2.c) Order summary

A summary of your order will then be sent to you by e-mail ("Your order has been dispatched"). This summary will show the total amount of the order, information relating to the cost and delivery time, the essential characteristics, quantity and price of the Products purchased.We advise you to keep this summary on an electronic medium.You will then receive an e-mail confirming dispatch of your order with your electronic invoice attached.

We do our utmost to ensure that our communications are sent to you as quickly as possible, but we advise you to check your "Spam" folder if you have not received the dispatch confirmation e-mail.

In application of article L213-1 of the French Consumer Code, when an order is for an amount equal to or greater than 120 Euros, Selyès retains the written record of the contract concluded between Selyès and a customer by electronic means for a period running from the conclusion of the contract until the date of delivery of the goods and for a period of ten years thereafter (in compliance with decree 2005-137 of February 16, 2005). You can then access this document at any time, on request to the Customer Service Department after providing proof of your identity.

5.3. Invoices

Your invoice will be sent by Selyès in a shipment confirmation e-mail. We make every effort to ensure that our communications reach you in a timely manner. However, it is possible that some e-mails may be classified as spam. You can also download your electronic invoices in the "Your orders" section of your personal account. A customer account is automatically created for each order. To access your e-invoices, you need to log in to your account. If you have never logged in before, you can click on the account confirmation email to create a password, or you can create a password directly on the site by clicking on "forgot password".

6. Prices - Accepted means of payment

6.1. Prices

The prices of the Products are on a Euro basis and are indicated in your devise, all taxes included. Selyès will not refund the VAT charged on purchases made on the Site, except in the case of refunds made in connection with the exercise of the right of withdrawal or for lack of conformity or latent defects.

Products are invoiced on the basis of the prices displayed on the Site at the time the order is placed.

All orders are payable in Euros or in your own devise and must be paid for at the time the order is placed.

6.2. Methods of payment accepted

6.2.a) Payment by credit or debit card

The following credit and bank cards are accepted: Visa®, MasterCard®, Carte Bleue®. Credit card payments are authenticated and secured using the 3D Secure system. This system is also known as "Verified by Visa®" or "MasterCard® SecureCode". During payment, the bank requests personal information from the Internet user to verify the cardholder's identity and validate the transaction.

How do I pay with 3D Secure on Selyes.fr? 

Once you have validated your bank details (card number, expiry date and cryptogram), a new page will be displayed on which you will be asked to enter the personal information requested by your bank.

This information may be :

- the answer to a personal question ;

- a password chosen by you beforehand;

- a code sent by SMS,

- your date of birth...

Once the 3D Secure code has been entered and validated by your bank, your order is finalized. Authentication is specific to each bank. If you have any questions about your 3D Secure code, please contact your bank directly. Your order will only be dispatched once we have verified your payment method and received authorization to debit your card. Your account will be debited as soon as your order has been placed.

6.2.b) Payment by Paypal

We accept payment via Paypal.

If you choose the Paypal payment option, you will automatically be redirected to the Paypal platform. If you do not have a PayPal account, you can create one at this time. After validating your order with Paypal, you will be redirected to the Selyès.fr confirmation page.

6.2.c) Credit notes and gift cards

Credit notes and gift cards are valid on the Selyes.fr website. They include codes that must be entered when validating your basket.

7. Reservation of Ownership

The Products ordered remain the property of Selyès until full payment has been received by Selyès, however, you assume all risks (including loss, theft or damage) associated with the Products delivered to y o u from the time of delivery to the address indicated at the time of order or from the time of collection in the case of collection or hand delivery.

8. In-store delivery and collection

8.1. Delivery and collection area

8.1.a) Delivery to a postal address

Products purchased on the Site and/or by telephone can only be delivered in mainland France, including Corsica and the Principality of Monaco (excluding Guadeloupe, Martinique, French Guiana, Reunion Island, Mayotte, New Caledonia and the French Southern and Antarctic Territories), Europe union, United states, Canada and Great Britain (hereinafter the "Delivery Zone").

It is not possible to place an order for any delivery address outside this Delivery Zone. For security and other reasons, Selyès will not process any orders for which a poste restante or P.O. Box address is provided.

If you would still like to order from Selyès even though you are not a member of the Products are shipped to the delivery address you provided during the order process.

We reserve the right to ask for a signature and valid proof of identity on delivery (e.g. passport or driver's license).

8.1.b) Pick-up at special points / Hand-delivered

It is possible for you to collect your order placed on the Site. This service is currently only available in certain partner stores. During the order process, you can check whether there is a store near you, or make an appointment to collect your order in person. You can designate another person to collect your order from the store (see article "8.3 Delivery and collection times").

8.2. Delivery charges

Standard shipping is free for any order under 200€ via the French Post Office in Metropolitan France, Corsica and Monaco.

Free shipping to Belgium for all orders containing 200€ of value via Mondial Relay, delivered to a relay point.

For different delivery services, the amount of the delivery charge is calculated according to the Products selected, the total value of your order and the delivery method chosen.

8.3. Delivery and collection times

When you place your order, we will inform you of the estimated delivery time, which will be confirmed in the order dispatch confirmation. The delivery time below begins as soon as your order is dispatched.

The following delivery times are estimated and may be extended in exceptional circumstances.

8.3.a) Delivery to a postal address

When you place your order, we will inform you of the possible delivery times and methods for the Products purchased and the country of delivery chosen. This amount will be payable by you in addition to the price of the Products purchased.

8.3.b) Delivery in France, Corsica and Monaco:

Colissimo :

- two (2) working days from dispatch.

Mondial Relay :

- three (3) working days from dispatch.

Orders that include a special "made-to-measure" order are subject to specific delivery times and costs.

8.3.c) Delivery in Europe :

Colissimo :

- three (3) to four (4) working days from dispatch.

Mondial Relay :

- three (3) to six (6) working days from dispatch.

Orders that include a special "made-to-measure" order are subject to specific delivery times and costs.

8.3.d) Delivery in USA, Canada and Great Britain :

Colissimo :

- three (3) to height (8) working days from dispatch.

UPS :

- two (2) to four (4) working days from dispatch.

Orders that include a special "made-to-measure" order are subject to specific delivery times and costs.

You may be asked to pay customs duties by the carrier you have selected for your order.

Selyès cannot be held responsible and will not reimburse you for these random additional charges.

8.3.d) In-store pick-up / Hand-delivered.

An e-mail or text message will be sent to you when your order i s available in store, or when it is possible to arrange an appointment in t h e hand-delivery area.

To pick up your order, please present yourself to the store manager or a salesperson when you arrive at the store, with :

- the e-mail informing you of the availability of your order (printed or on the

screen of your telephone);

- and your ID.

If you have chosen a withdrawal by another person, this person must come with :

- the e-mail informing you of the availability of the order;

- a written power of attorney from you giving him the right to collect your order;

- a copy of your identity card ;

- and identification.

You have three (3) weeks from receipt of t h e e-mail informing you that your order is available in store to collect it. Failing this, Selyès reserves the right to cancel the order without refund.

If you have chosen hand-delivery, a meeting place and date will be agreed between Selyès and the customer within a 15 km radius from Orleans.

The customer must bring :

- the e-mail notifying the appointment; - identification.

If another person is picking up your order, this person must also present : - identification ;

- a written power of attorney giving him the right to collect your order.

9. Delivery problems

Any failure or delay in delivery, or in making your Products available in store, which exceeds the delivery times mentioned in article 8.3 must be reported to our Customer Service department as soon as possible. Any complaint made more than thirty (30) calendar days after the date of validation of your order will not be taken into account.

You must check the conformity of the Products at the time of delivery and indicate, if possible on the delivery note, in the form of handwritten reservations accompanied b y your signature, any anomalies noted (open package, damaged product, etc.).

You must then contact Customer Services (see Article 3). In the event of non-conformity of the Products purchased, or if you are not satisfied with them, you may submit a complaint in order to be able to return them or request an exchange or refund under the conditions set out in Articles 10 "Right of withdrawal" and 11 "Return, exchange and refund procedures".

Customized and/or personalized products cannot be returned, exchanged or reimbursed, except for defects or problems due to transport.

 

10. Right of withdrawal

10.1. Right of withdrawal and withdrawal period

You have a legal right of withdrawal that you can exercise under the conditions set out in articles L221-18 and L221-20 of the French Consumer Code, if you meet the conditions set out in these provisions, without having to justify your decision or pay any penalties.

Selyès' general return policy (for refund or exchange) allows you to cancel your order within fourteen (14) days from the date of delivery of the Products, without having to justify your reasons and without having t o pay any penalty. Once this period has elapsed, you will no longer be able to exercise your right of withdrawal.

10.2. How to exercise your right of withdrawal

You can send your cancellation request by contacting our Customer Service or use the model cancellation form available in the appendix to these General Terms and Conditions of Sale.

10.3. Restriction of the right of withdrawal

In accordance w i t h article L. 221-28 of the French Consumer Code, your right of withdrawal cannot be exercised for orders for personalized and/or custom-made Products; except when said Products are returned b e c a u s e they are defective.

Products that do not fit properly cannot be considered defective. The customer is entirely responsible for taking measurements according to the size guide provided by Selyès with a t a p e measure, adjusted to the desired size (with margin).

Selyès manufactures its products in strict compliance with these measurements. If you have any problems, please contact customer service.

10.4. Consequences of the right of withdrawal

When exercising your right of withdrawal or in the event of non-conformity of the Product, you may return the Product(s) purchased and request an exchange or refund under the conditions described i n article 11 below.

  

11. Return, exchange and refund policy

11.1. From the Selyes.fr website

11.1.a) Return procedure

When exercising the right of withdrawal, Products must be returned in their original condition and packaging (pouch and, if possible, the shipping carton), accompanied by their purchase invoice or a copy in the case of a partial return. The return o f a Product f o r exchange or refund is at your expense.

To do this, you must return the Products to us via the means of your choice, a t t h e workshop address, within a maximum period of fourteen (14) days from your declaration of withdrawal.

We strongly advise you to take out the insurance offered by your carrier. You will be solely responsible for the return of the Products. Selyès will n o t b e responsible for lost, misdirected or delayed delivery of a Product you wish to return to the Site, as the risks of the transport you choose rest with you alone.

In the event of an exchange, the cost of returning the item to our workshop remains at your expense, however the cost of the second delivery will be offered by Selyès. Under no circumstances will it be possible to give you a credit note for use on the Site.

If you have any questions, please contact our Customer Service department.

11.1.b) Exchange

In the event of a n exchange request, please specify in the dedicated field the Product(s) you wish to receive in exchange for your order. If the amount of t h e Product(s) chosen as a replacement is greater than the amount of the Product(s) returned, you will be required to pay the price difference b y credit card using our secure payment service.

If the amount of the Product(s) chosen as a replacement is less than the amount of the Product(s) returned, the price difference will be reimbursed by Selyès (remember that for gifts, only the customer who purchased the gift can request reimbursement and have their bank account credited).In the case of an exchange, you will be responsible for the return shipping costs and Selyès will pay the shipping c o s t s for the second shipment.Please note that the exchange will take place upon receipt of the Product(s).

 

As an exception to the foregoing, no exchange will be made for personalized and/or

custom-made products, except when said Products are returned because they are defective.

Products that do not fit properly cannot be considered defective. The customer is entirely responsible for taking measurements according to the size guide provided by Selyès with a tape measure, adjusted to the desired size.

Selyès manufactures its products with these measurements in mind.

11.1.c) Refund

If a refund is requested, it will be made within seventy-two days.

(72) working hours from receipt of the Product(s). A confirmation e-mail will be sent to you. Please note that your bank may take up to ten (10) working days to issue a refund to your card, depending on processing times. This varies from card issuer to card issuer, and Selyès is unable t o accelerate this process beyond our control.

11.1.d) Gifts ordered from the Site

Third-party recipients of gifts ordered from the Site may only exchange the Products via the Site's returns procedure. Consequently, only the customer who purchased the gift may request reimbursement within the framework of the right of withdrawal (insofar as only the bank account of the person who ordered the product may be credited again). If necessary, only an exchange for a Product of equivalent or greater value (the price difference must then be paid by the third-party recipient of the gift) is possible. The third- party beneficiary must contact our Customer Service Department, which will register the exchange.

11.1.e) Specific products ordered from the Site.

11.1.e) (i) Return conditions applicable to personalized and/or customized products

No exchange or refund is possible with this type of Product, except when the Product is returned because it is defective.

Products that do not fit properly cannot be considered defective. The customer is entirely responsible for taking measurements according to the size guide provided by Selyès with a tape measure, adjusted to the desired size.

Selyès manufactures its products in strict accordance with these measurements. If you have any questions, please contact our Customer Service.

 11.1.f) Return, exchange and refund conditions for orders paid with PayPal

In the event of a request t o exchange an order paid with PayPal, your bank or credit card details will be required if the amount of the new order is greater than the amount of the initial order. Any amount over and above the amount of the original order may be paid by PayPal or credit card.

If the amount of the new order is equal to the amount of the original order, you will not need to provide your credit card information and no new payment will be required.

If you request a refund for an order paid by Paypal, your PayPal account will be credited with the amount of the original order.

11.2. For products picked up in a partner store and/or delivered by hand

If you would like to pick up your order in a partner store, please ask :

- an exchange (except for personalized and/or custom-made products when said Products are defective). )

- a refund (except in the case o f an order received as a gift). The boutique will contact the workshop to deliver your returned Products and proceed with the refund within seven (7) working days. Refunds will be made using the same payment method you used to place your order.

These requests must be made by submitting a complaint directly on the Site (Heading "Contact us") before any deposit in a partner store.

Products returned without prior approval from Selyès will not be exchanged or refunded.

Personalized and/or customized products are neither exchangeable nor refundable, except when said products are returned because they are defective.

12. Legal and commercial warranties

12.1. Legal warranties

Products sold by Selyès are subject to the legal warranties set forth in Articles L217-4 to L217-14 of the French Consumer Code and Articles 1641 to 1648 of the French Civil Code, to t h e exclusion of all other warranties:

- Legal Warranty of Conformity: Selyès will deliver to you a Product which conforms to the contract and is free from defects of conformity at the time of delivery of said Product, in the sense that the Product will be fit for the use usually expected of a similar good and will have the characteristics described at the time of sale. Selyès is also liable f o r defects in conformity resulting from packaging, assembly instructions or installation when the latter has been made its responsibility under the contract or has been carried out under its responsibility. This warranty only applies if you request it within two years of delivery of the goods. Defects of conformity which appear within twenty-four (24) months of delivery are presumed to have existed at the time of delivery, unless proven otherwise.

You may choose between repair and replacement of the Product, unless one of these options would entail a manifestly disproportionate cost for Selyès. If repair or replacement of the Product is not possible, you may have the price paid refunded and return the Product or keep the Product and have part of the price refunded, unless the lack of conformity is minor. The repair, replacement or refund of the Product will be free of charge (in addition to the cost of return postage) to you and does not preclude t h e possible award o f damages in the event that you are entitled to them. The legal warranty of conformity applies independently of the commercial warranty indicated in the Article.

12.2 below.

- Legal warranty against latent defects: Selyès will deliver to you a Product free from latent defects which render it unfit for its intended use, or which diminish this use to such an extent that you would not have purchased it, or would only have paid a lesser price for it, had you been aware of them. This warranty will only apply if you make a claim within two (2) years of discovery of the defect. In the event of a latent defect, you will have the choice of returning the Product and having the price and costs of the sale refunded to you, or keeping the Product and having part of the price refunded to you. In all cases, it is up to you to prove that you meet the warranty conditions.

 

In the event of lack of conformity or hidden defects, you must return the Products to our workshop by contacting our Customer Service Department.

12.3. Commercial warranty

Certain Products sold on the Site benefit f r o m a commercial warranty i n addition to the legal warranties referred to in t h e previous article. The content and terms of this commercial guarantee are specified on each article benefiting from it.

13. After-sales service and spare parts availability

All technically repairable products are covered by an after-sales service. For repairs, please contact our Customer Service Department.

In accordance w i t h article L 111-3 al 1 of the French Consumer Code, Selyès confirms that n o period of availability of spare parts essential to the use of the Products is guaranteed. Nevertheless, Selyès will make its best efforts to satisfy its Customers in the event of a request for one or more spare parts.

14. Limitation of liability

In no event will Selyès be liable for any damages whatsoever arising out o f or in connection with a breach by Selyès of any of its obligations.

15. Applicable law - Disputes

These General Terms and Conditions of Sale are governed by and construed in accordance with French law. In the event of any dispute relating to the application and/or interpretation of these General Terms and Conditions of Sale, you may contact our Customer Service Department (see Article 3).

You can also use conventional mediation or any other alternative dispute resolution procedure.
